Palm of the Dreamer

Hello guys, ive been using this item on my DoT Lich, but it appears that the Gloom effect doesnt apply consistently when enemies are killed by my dark effiegies(the effect applies about like 50% of the times), it happens on all creatures not only on simulacrum ones like others have reported. Can someone confirm this?
